Alwayz In Motion Auto Rentals LLC - Rental Terms & Conditions

Please review the following terms carefully before completing your booking.

By booking a vehicle with Alwayz In Motion Auto Rentals LLC, you agree to the following terms and conditions. These terms form a legally binding agreement between you (“the renter”) and Alwayz In Motion Auto Rentals LLC (“the company”).

1. Age and Eligibility

Renters must be 25 years of age or older.
A valid, unexpired driver’s license and active auto insurance are required.
The name on the license and insurance must match the renter’s booking information.
All rentals are subject to approval following ID and insurance verification.

2. Authorized Drivers

Only the renter and individuals listed in this agreement may operate the vehicle.
Unauthorized drivers are strictly prohibited and will void the rental agreement and insurance coverage.

3. Vehicle Condition and Use

Smoking or vaping in vehicles is prohibited. A $250 cleaning fee applies if smoke or vape odor is detected.
Pets are not allowed unless pre-approved in writing.
The vehicle must be returned in the same condition as rented. Excessive dirt or debris will result in a cleaning fee between $50–$150.
The vehicle may not be used for racing, reckless driving, towing, off-roading, or any illegal activity.
Rideshare or delivery use is only permitted if pre-approved and properly insured.

4. Mileage Policy

Mileage Allowance

• Daily Rentals: Includes up to 250 miles per day

•Weekly Rentals: Includes up to 1,000 miles per week

Additional Mileage

If mileage exceeds the included limit, an overage fee of $0.50 per mile will apply.

This charge helps cover vehicle maintenance, tire wear, and overall upkeep to keep every ride smooth and safe.

Example Calculations:

• A daily rental driven 300 miles would incur 50 extra miles × $0.50 = $25.00 additional charge.

A weekly rental driven 1,150 miles would incur 150 extra miles × $0.50 = $75.00 additional charge.

Note to Renters

Please track your mileage throughout your rental period to avoid additional fees at vehicle return. All mileage is verified at both pickup and drop-off for accuracy.

5. Fuel Policy

Vehicles must be returned with the same fuel level as at pickup.
If the vehicle is not returned full, a $25 refueling fee plus fuel cost will apply.

6. Security Deposit and Payments

A refundable $250 security deposit is required for all rentals.
The deposit may be used to cover:

Damages, cleaning, or excessive wear,
Unpaid tolls, parking tickets, or other violations, and
Any balance due after return.

Refunds are processed after vehicle inspection and may take up to 5 business days, depending on your bank.

7. Late Returns

A one-hour grace period is allowed.
After one hour, the daily rate will apply.
Unapproved late returns may also incur additional administrative fees.

8. Accidents and Damage

If an accident, damage, or mechanical issue occurs:

Notify Alwayz In Motion Auto Rentals LLC immediately.
Do not abandon the vehicle.
Obtain a police report when applicable.
The renter is responsible for all damages, towing, and repairs not covered by their insurance.

9. Tolls, Tickets, and Violations

The renter is responsible for all tolls, tickets, and traffic violations incurred during the rental period.
Unpaid tolls or violations will be charged to the payment method on file, plus a $10 administrative fee per occurrence.

10. Termination and Repossession

Alwayz In Motion Auto Rentals LLC reserves the right to terminate the rental and repossess the vehicle without prior notice if:

The renter violates any policy terms,
The vehicle is used unsafely, or
Payment or verification is invalid or incomplete.

No refunds will be issued in cases of termination due to policy violations.

11. Liability and Responsibility

The renter assumes full responsibility for the vehicle and all associated risks during the rental period.
Alwayz In Motion Auto Rentals LLC is not liable for:

Injury to persons,
Loss or damage to personal belongings, or
Consequential or indirect damages arising from use of the rental vehicle.

The renter agrees to indemnify and hold harmless the company from any claims, losses, or liabilities arising from their use of the vehicle.

12. Cancellations and Refunds

Cancellations must be made prior to the pickup date to be eligible for any refund.
Processing fees may apply.
The company reserves the right to cancel bookings if verification is incomplete or eligibility requirements are not met.

13. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of North Carolina.
Any disputes shall be resolved in the courts of Wake County, North Carolina.

14. Agreement

By completing your booking and selecting “I Agree” during checkout, you acknowledge that you have read, understood, and accept all terms and conditions stated above.
